Terms and Conditions
Article 1 - Definitions
For the purposes of these terms and conditions, the following definitions apply:
- Business day: Monday to Friday, excluding public holidays in the United States;
- Consumer: an individual who is not acting for the purposes of their trade, business or profession, and who enters into an agreement with the trader through the website;
- Day: a calendar day;
- Order: an offer by the consumer to purchase one or more pieces from the trader;
- Piece: a single item of jewellery offered by the trader;
- Return period: the time frame within which the consumer may return a piece, as set out in Article 7;
- Trader: Adenza B.V., trading as Mabel & Iris Jewels, offering products to consumers at a distance;
- Website: mabelandirisjewels.com;
- General Terms and Conditions: these General Terms and Conditions of the trader.

Article 3 - Applicability

These general terms and conditions are applicable to every offer from the trader and to every agreement and order made between the trader and the consumer.

Prior to the conclusion of an agreement, the text of these general terms and conditions shall be made available to the consumer on the website in a form that can be saved and printed.

If one or more provisions in these general terms and conditions are at any time wholly or partially null and void or are nullified, the agreement and these terms and conditions will otherwise remain in effect, and the provision in question will immediately be replaced by a provision that approximates the original as closely as possible.

Where these terms conflict with the trader's Refund Policy, Shipping Policy or Privacy Policy on a specific point, those policies take precedence on that point.
Article 4 - The offer

If an offer has a limited duration or is subject to conditions, this will be explicitly stated in the offer.

The offer is without obligation. The trader is entitled to change and amend the offer.

The offer contains a full and accurate description of the offered products. The description is sufficiently detailed to enable a proper assessment of the offer by the consumer.

Images are a truthful representation of the offered products. Colours may appear differently on different screens. Obvious mistakes or errors do not bind the trader.

Pieces are described by colour and finish. No piece is offered as solid gold and no karat or precious-metal fineness is claimed for any piece.

Stock is limited and pieces are not restocked once sold out.
Article 5 - The agreement

The agreement is concluded at the moment the consumer accepts the offer and meets the corresponding conditions.

If the consumer has accepted the offer electronically, the trader will immediately confirm electronically the receipt of the acceptance of the offer.

The trader operates a 24-hour cancellation window. An order may be cancelled free of charge within 24 hours of being placed, as processing may begin after this period. After 24 hours the order can no longer be cancelled, but the piece may still be returned within 30 days of receipt in accordance with Article 7.

The trader may refuse an order, or cancel it and refund in full, where a piece is unavailable, where an order appears fraudulent, or where the delivery address falls outside the area the trader ships to.
Article 6 - Prices and payment

The amount payable for an order, including any applicable fees, is displayed at checkout before the order is placed.

All amounts are stated in US dollars.

Payment is taken at the time the order is placed.

The amount payable for an order is the amount displayed at checkout at the moment that order is placed, and is the amount refunded under Article 7.
Article 7 - Right of return

Consumers have the right to return their piece within 30 days of receiving the order, without providing a reason.

During this period, the consumer must handle the piece and packaging with care and may only use it to the extent necessary to assess its nature and functionality.

To start a return, the consumer contacts within the return period. The trader will respond with the return address and instructions. Pieces returned without prior contact may not be identifiable to an order and may not be refunded.

The piece must be sent back within 14 days of the consumer receiving the return instructions, unworn and in its original condition.

Return shipping costs are the responsibility of the consumer unless otherwise specified. The consumer bears the risk of the return shipment until it arrives, and a tracked service is recommended.

Refunds will be issued within 5 business days after the returned item has been received and inspected. The amount refunded is the amount the consumer paid at checkout in respect of the piece returned. The trader reserves the right to withhold the refund until the returned item has been received.

Where an order contained more than one piece, the amount refunded is the amount paid at checkout in respect of the piece returned. Returning all pieces in an order refunds the full amount paid for that order.

The trader may reduce or refuse a refund where a returned piece has been worn, damaged or altered beyond what is necessary to examine it.
Article 8 - Costs in case of return

The consumer is responsible for the cost of return shipping.

Refunds will be issued using the same payment method used for the original transaction, unless otherwise agreed.

Where a piece arrives damaged, faulty or not as described, the trader bears the cost of return shipping, and the consumer may choose between a replacement and a full refund. The consumer should report such a piece within 30 days of delivery, with a photograph.
Article 9 - Delivery

Orders are packed within 1 to 3 business days of the order being placed.

Delivery normally takes 5 to 10 business days from dispatch. These periods are estimates and are not guaranteed delivery dates.

A tracking link is sent by email once the parcel has been dispatched.

If the trader is unable to dispatch an order within 30 days of the order being placed, the consumer will be notified and may cancel the order for a full refund.

The consumer is responsible for providing a correct and complete delivery address. Parcels returned to the trader as undeliverable due to an incorrect address may be resent once the consumer has paid the applicable shipping charge again.

Risk of loss or damage passes to the consumer upon delivery to the address given in the order.
Article 10 - Complaints

Complaints concerning an order should be sent to , quoting the order number, as soon as reasonably possible after the consumer has identified the issue.

The trader acknowledges complaints promptly and aims to resolve them within 14 days. Where a complaint requires a longer processing time, the consumer will be informed when a response can be expected.
Article 11 - Intellectual property
All content on the website, including text, photographs, graphics, and the Mabel & Iris Jewels name and logo, is the property of the trader or its licensors and may not be copied, reproduced or reused without prior written permission.
Article 12 - Liability

Nothing in these terms excludes or limits the trader's liability where such liability cannot lawfully be excluded or limited.

Subject to paragraph 1, the trader's total liability arising out of or in connection with an order is limited to the amount paid by the consumer for that order.

The trader is not liable for delays or failures in performance caused by circumstances beyond its reasonable control, including carrier delays, extreme weather, and interruptions to postal or courier services.
Article 13 - Privacy
Personal data is processed in accordance with the trader's Privacy Policy, which is available on the website.
Article 14 - Governing law

These terms and conditions are governed by the law of the state in which the consumer resides.

Nothing in these terms and conditions affects the consumer's mandatory rights under applicable consumer protection law.
Article 15 - Amendments
The trader is entitled to amend these general terms and conditions. The version published on the website at the time an order is placed is the version applicable to that order.
